My game is constantly giving me the option to surrender in the bottom right but I didn’t think anything would come of it so I kept playing but when I came to sleep it won’t allow me to because the same button to sleep is used for surrendering and now I am out of energy and pass out every few minutes any suggestions? I have already tried surrendering to a guard fast traveling and waiting nothing works
I remember a quest where you had to run away from guards or something like that. If you are there, then just go to the waypoint for the quest. After that you should be able to sleep and do other things. If youre not in such an quest, then I would consider this as a bug.
I am not in that quest it is from the random searches that happen in Rattray but it did not disappear after I was searched
Same thing happened to me. Try committing a crime in public then paying/serving the time for it. I stole a pretzel then paid 60 groschen to be rid of the permanent surrender option. The loss of groschen & reputation [both will be earned back 
] is negligible compared to Henry not being able to sleep in his own bed. Now I can sleep again and it feels great!!! Did this on xbox one, hope it works for you. Just trying to help KC:D players I’m not a robot- I have heart, soul, blood, body & eventually remains.

I’m having the same problem now. Fyi if it happens again, know you can’t sleep in beds, but you can sleep on hay piles in a barn or campsite. There are so many bugs I’m thinking about not playing for a few months until its cleared up. Sad really.
