Nope he won’t be put through a huge trial . For that very reason . As I said before our justice system is not as harsh as yours . In most cases it’s too fucking soft .
The trial will be pretty clear cut and most likely end up a fine . At worst a suspended sentence .
They always take into account his age . Because if they gave him the maximum sentence of ten years he would most likely die in there which they don’t want .

The U.S. is well known for having a very hard justice system and giving out very harsh sentences

Where are you getting this from? Sounds to me like you’re being a typical European and latching on to stereo types. If you looked, yes I’m sure you could find harsh sentences in a nation of 320 million people. I’m also willing to bet you could find many in the U.K as well. I personally know people who have gotten off very lightly for doing serious things.
He was found with an illegal weapon in his trunk. Surly that constitutes prison? After all an 80 year old man with a shotgun sure is a threat.
How do you know it will be thought about? Where are you getting all these details about this case? Are you a member of the jury perhaps?

Nope it does not mean prison . It’s completely dependnt on his intentions .
Was he in fear of his life for whatever reason ?
Was he goinng after somebody ?
Was he simply transporting it ?
And it would be up to the jury to decide if he posed a threat .
Using @snejdarek as an example , if his CC liscence ran out on a Wednesday and he forgot to renew it (assuming you have to renew every few years ) and he was caught on the Friday carrying his weapon as usual but with a invalid permit . He would have to explain himself to the police/courts I’m sure .
But they are hardly going to lock him up . Because his intentions were not to harm any individual without just cause .
Going back to the old man . If he was in fear of his life for any reason (a legit reason ) such as being mugged and beaten up in the past and he had it in his Car for his own protection . They would take that into consideration . While it’s illegal to own a weapon for self defence , it would be dealt with on a case to case basis .
If the jury feel he was in danger he would likely get away with the gun being confiscated and a slap on the wrist .
Because that’s standard practice here . If your unfit for trial someone else can go in your place or you can use video link .

Actually here the maximum sentence for simple illegal gun possession is 2 years. At the same time first time offenders sentenced to less than 3 years can’t get jail time. Courts can either give them suspended sentence or alternative punishment (usually public works, e.g. street cleaning).
Considering that I had a valid license up until a certain point (renewal is every 10 years and basically needs only new general practitioner health clearance - like old car drivers) and I was fulfilling the requirements at the time it lapsed, i.e. its issuance would be shall issue and only a simple administrative thing with the authorities not being able to deny it, it would be most probably considered as misdemeanor subject to a fine. A single misdemeanor would still not preclude me from applying for the license again (a person must commit 2 misdemeanors within 3 years to be precluded).
Meanwhile, the MINIMUM sentence for illegal firearm possession in UK is 5 years.

an old man with a shotgun isnt a huge deal . had it been a black gang member with a shotgun it would be a whole different story .

[/quote] true to a point but it depends on exactly what they chose to prosecute you for . if they perused a charge of possession of an illegal firearm , then yes you would face 5 years but they wont always . sometimes they will offer a deal where you plead guilty to a lesser charge . that way its cheaper for the government and such .
i found the follow up on the gentlemen . he was jailed for 2 years (a little harsh in my opinion) . they charged him for possession of a loaded firearm in a public place . he did infact hold a certificate for the gun . when police searched his house however . they found other weapons were not secure .
he has also lost his certificate and weapons/ ammunition
i highly doubt he will serve the full sentence because no one ever does here . much to my annoyance .
if you get a life sentence you will be out in 18 rather than the full 25 if you show good behaviour

In regards to the story, thats a tragic accident and it seems like a weapons malfunction. Gun control would not have prevented his death. If the kid actually pulled the trigger than that’s on the parents for not teaching trigger discipline.
